CNSC: Disqualifying GFR in CE Oltenia coal freight auction, unfounded

Grup Feroviar Român (GFR, Romanian Railway Group) has received a positive decision for the third consecutive time, with regard to the coal transport tender organized by Oltenia Energy Complex (CE Oltenia), after the decisions of May and August 2014, according to a press release received by energynomics.ro.

The National Council for Solving Complaints (CNSC) agreed with GFR, arguing that the rejection decision taken by the contracting authority disqualified the GFR offer without concrete reasons, therefore breaching legal provisions.

CE Oltenia decided to disqualify the GFR offer, claiming that it would be unacceptable and inconsistent, and GFR reported the decision to CNSC, which decided that the largest private rail operator of Romania was in title to attend to the auction.

By the CNSC’s decision of 27 February, CE Oltenia is obliged to cancel the report on the outcome of the proceedings and submissions procedure, to restore the report of the contract award procedure and communications on the outcome of the procedure.

CE Oltenia has 10 days from the date of the decision to proceed with complying to the decision, within the reasons offered by CNAS.
