CC ruled as unconstitutional the time limit for challenging the norms issued by ANRE

The article of law which states that ANRE orders and decisions may be appealed at the Bucharest Court of Appeal within 30 days of publication in the Official Gazette, violates the fundamental law, established the Constitutional Court (CC).

The Article 5, paragraph 7 provisions of the Emergency Ordinance no. 33/2007 regarding the organization and functioning of ANRE, which sets a deadline for challenging by the administrative way the administrative acts with normative aspects, issued by ANRE President in exercise of his powers, are unconstitutional, explained CC.

The decision was taken unanimously by the judges of the CC. The decision is final and binding and shall be communicated to the two Houses of Parliament, Government and the Bucharest Court of Appeal – Section VIII of administrative and fiscal.

The exception of unconstitutionality was raised in a lawsuit which took place at the Bucharest Court of Appeal, where CET Govora requested the cancellation of a document issued in December 2014 by ANRE.
