Contracts for the sale and purchase of gas on the wholesale market concluded after July 1, 2020, regardless of the origin of natural gas (domestic production, import, export) generate a supply obligation for market players, who also, together with the operators of centralized markets (OPCOM and RCE) also have the obligation to report to the National Energy Regulatory Authority (ANRE), according to Profit.ro.
Lack of offer of the traded gases, either by the buyer or by the seller, is sanctioned with a fine between 5% and 10% of the turnover, warns ANRE, referring to the article of the law that defines the contraventions in this market.
ANRE makes these clarifications in a document detailing how manufacturers, suppliers or importers have to report concluded contracts. By amending the Law on Electricity and Natural Gas, between July 1, 2020 and December 31, 2022, all participants in the natural gas market, except producers whose annual production in the previous year exceeds 3,000,000 MWh, to the extent that they contract the sale or purchase of natural gas on the wholesale market, in a calendar year, have the obligation to offer annually, as a seller/buyer, quantities/purchase requests on the centralized markets.
