National Regulatory Authority for Energy (ANRE) has nearly 390 ongoing litigations, Mediafax writes. A number of lawsuits have been filed against the authority because it “promoted legal actions against jurisdictional administrative acts issued by Romania’s Accounting Court, action to recover debts from regulated economic operators, debts coming from non-payment of contributions and charges related to licenses /certificates/permits granted by ANRE, labor disputes, civil actions”, indicates ANRE.
Two of the state companies which are involved in litigation with ANRE are Electrocentrale Bucharest and Transgaz, specified the institution. In fact, the launching of these legal actions goes both ways. “ANRE has sued Electrocentrale Bucharest SA and Transgaz for debt recovery, and these acted against ANRE in court for cancellation of some administrative acts”, stated ANRE for Mediafax.
Transgaz file as object the annulment of a decision on wholesale and retail market disputes arising between gas market participants. Electrocentrale dossier targets the annulment of a decision on overcompensation of highly efficient CHP production for the period 2011-2013 for CHP plants CHP Bucharest South plant and CHP Bucharest West plant. Another case concerns the amendment of a decision on the conclusion of disagreements between Electrocentrale and RADET.
The debts to be recovered by ANRE and for which the authority has sued Electrocentrale Bucharest comes from non-payment of related contribution to electricity generation license granted by ANRE and accessories (late payment), and debits to be recovered by ANRE for which sued Transgaz come from non-payment until maturity of gas transit tariff for dispatching activity in 2008-2012.
