Competition Council draws the attention of the professional associations that each company must independently establish its commercial policy, and the anticipation of a certain price that should be practiced may fall under the provisions of the Competition Law, it is specified in a release.
“Professional organizations have a beneficial role for both its members and consumers, informing them about industry developments, setting quality and safety standards for the services provided by associate members. We draw attention once again to the fact that an association can be held responsible for violating competition rules when decisions, recommendations or any other activity undertaken by it influence the behavior of companies, affecting competition between them,” said Bogdan Chiritoiu, President of the Competition Council.
If in the meetings of the association, the companies are agreed to implement a concerted behavior, the practice can be sanctioned from the perspective of national or community competition rules. In fact, both the Romanian Competition Council and the European Commission and the community courts have investigated a series of cartel cases that were based, among other things, on this type of mechanism, Council officials also said.
