The Executive approved on Friday, in the Government meeting, at the proposal of the Ministry of Environment, Water and Forests, the Emergency Ordinance for the modification and completion of GEO no. 196/2005 regarding the Environmental Fund, according to a press release from MMAP.
Following the approval of this emergency ordinance, the management of the IT systems that allow the monitoring of waste transactions on the national territory, in order to effectively monitor and verify the correctness of waste transactions in our country, will be included in the responsibilities of the Environmental Fund Administration (AFM).
At the same time, the Environment Fund Administration will implement two financing programs provided for in the National Recovery and Resilience Plan (PNRR), respectively the “First Connection” Program, which will ensure the connection/connection of vulnerable households to the water supply and sewage. Also, AFM will be responsible for the management of closure and greening of non-compliant waste deposits, based on a Decision of the Court of Justice of the European Union, according to Agerpres.
In the press release it is mentioned that, in order to align with new legislative provisions that appeared recently, as well as for the clarification of certain taxes/contributions and the correct implementation of the measures provided by the normative acts, it is necessary to amend/complete/reformulate the article relating to the taxes and contributions that income is made to the Environmental Fund, respectively art. 9 para. (1) lit. d), q) and v) (respectively those related to packaging waste, ecotax, OIREPs). At the same time, the articles related to the declaration and payment of taxes/contributions are also amended accordingly.
Also, the ordinance approved on Friday clarifies/completes the categories of legal entities that use the SIATD computer application. In order to ensure control over the quantities of waste traded, obligations and sanctions are imposed on economic operators who trade waste on the national market, in the sense of using the IT application SIATD in order to monitor and verify the traceability of waste. At the same time, sanctions were imposed on economic operators who carry out collection/utilization/sanitization/brokerage activities and who report false data through the SIATD computer application.
The Ministry mentions that, for the correct implementation of the extended producer liability system, certain guarantees are established for economic operators who carry out collection/recovery/sanitization/brokerage activities and report waste for certain categories of taxpayers.
With a view to debureaucratization and digitalization, the submission of declarations to the Environmental Fund will be possible through electronic means of remote transmission.
Taking into account the new changes, the ministry specifies that a compliance period has been imposed on economic operators, with certain measures provided for in the draft applying starting from January 1, 2023.
Certain instructions provided in the ordinance on the amendment of GEO no. 196/2005 are to be approved by order of the head of the central public authority for environmental protection, at the proposal of the AFM, within 180 days from the entry into force of the amending ordinance.
