How is the regulatory climate impacting upon the investment strategies of the energy companies in Europe?
The regulatory environment determines rate-of-return and risk & uncertainty of investments; it affects the company’s profitability and credit rating. Basically, what the market is for a company facing competition, is the regulatory environment for a regulated firm; it determines the outcome.
What are the main European regulatory climate changes the companies should prepare themselves for in the near future?
The demand for infrastructure investment is massive and according to the European Commission, it comes too slowly. As is already the case, the European Commission is highly likely to promote further infrastructure investment in the near future. The best current example of European policy is the program for further steps in the “Internal Energy Market”.
How can energy companies influence the regulatory climate in Europe and hence, turn those changes and perspectives into a competitive advantage?
Companies can strategically game the regulation to make the best out of investment opportunities. For example, accelerated or delayed investment or the strategic use of investment promotion instruments (subsidies, tax-exemptions). Finance of the infrastructure investment turns out to be a challenge; good financial management can create a competitive advantage.
What is the role of the general public in debates and European policy agendas, and how can a company win public trust?
Energy policy attracts massive public attention and dealing with public acceptance turns out to be a major political issue. Renewable energies and nuclear power are big issues. So is the „NIMBY“-problem for new infrastructure. Network companies are setting up departments for public affairs with experts on public communication.
