Niculae Havrileț, Chairman of NARE, was declared incompatible by NAI

The President of the National Regulatory Authority for Energy (ANRE), Niculae Havrileţ has been declared incompatible by the National Integrity Agency (ANI), because he has simultaneously detained the position with the rank of Secretary of State and that of General Manager of the company Gascop, company with the main activity in the sector under the jurisdiction of ANRE, notes Mediafax.

The incompatibility occured on 6 June 2012, notes the ANI release. The ANRE Managing Committee members cannot be members in the management of companies with activities in the electricity, heating and gas sector, or in any other areas within the competence of ANRE.

ANI says Niculae Havrileţ violated the provisions of Article 84, paragraph 2 of Law 161/2003, according to which “the position of Secretary of State, the position of Subsecretary of State and the similar positions assimilated are incompatible with the exercise of any other public authority position as well as the exercising of the positions under para. (1), let. c)”, respectively the Government member position is incompatible with (…) the position of (…) General Manager (…) within other companies”.

Niculae Havrileţ claims he resigned from the position of General Manager of Gascop before the appointment to the leadership of ANRE. “I resigned immediately from the former position when I was appointed to the current position. I do not know what situation caused this decision. I will challenge it in court,” said Niculae Havrileţ quoted by Mediafax.

The ANRE President was informed about the initiation of the evaluation procedure, and he filed a point of view to the evaluation file, said ANI. The resulting penalty for identifying an incompatibility of this kind is the prohibition of occupying a public office position for three years, the dismissal or the termination of the mandate. The ANI Report can be challenged in court by Niculae Havrileţ.
