A Romanian won, in the first instance, a lawsuit with the Administration of the Environmental Fund (AFM) in the thorny issue of rejecting the financing files through the “Green House of Photovoltaics” program, writes e-nergia.ro. The AFM can appeal.
The Constanța Court ruled in favor, on February 4, of a citizen who sued AFM after the institution rejected his case on the grounds that the documents had expired. The court orders the institution to finance the man’s photovoltaic installation and to pay his court costs. The decision is not final.
AFM refused to accept the funding file on the grounds that its documents had expired. The institution considered that the land book extract was older than 30 days from the date of enrollment in the program and that the certificate of fiscal attestation on local taxes and fees was also not valid on the date of submission of the file in the application, although the institution promised not to resort to such procedures, following the long delay of the approval process.
